Limitation of Liability
1. No warranty
The software and services are provided “as is” and “as available”. To the maximum extent permitted by law, the author gives no warranty of any kind, whether express, implied or statutory, including any warranty of merchantability, fitness for a particular purpose, title, accuracy, quiet enjoyment or non-infringement. No advice or information, whether given in documentation, chat, issue trackers or otherwise, creates a warranty.
2. No guarantee of results
No promise is made that the software or services will work, will work on your hardware, will be free of defects, will be secure, will be available, will preserve data, or will be suitable for any particular task. Testing and verification are your responsibility.
3. What is not covered
To the maximum extent permitted by law, the author is not liable for any loss or damage arising out of or related to the software or services, including:
- loss, corruption or disclosure of data;
- hardware damage, including drives, storage media, firmware or firmware settings;
- loss of time, work, goodwill, profits, revenue, or business opportunity;
- service interruption, downtime, or inability to use the software;
- damage caused by a failed install, boot, repartition, restore, virtual machine or write operation;
- damage caused by software defects, bugs, misconfiguration, or user error;
- damage caused by third-party software, repositories, hosting, or payment providers.
4. No remedy for indirect or consequential loss
To the maximum extent permitted by law, there is no remedy for indirect, incidental, special, punitive or consequential loss or damage, or for any loss that was not a reasonably foreseeable result of the breach at the time it occurred. This exclusion applies even if the author was told that such loss was possible.
5. Cap on liability that cannot be excluded
Where liability cannot be excluded, it is limited to the amount you paid for the specific service giving rise to the claim in the 12 months before the event. For everything currently offered — including takhiOS, the UIL Platform and the free Locker testing service — that amount is zero. The cap does not apply to liability that the law does not allow to be capped.
6. Rights that cannot be waived
Nothing in these documents excludes or limits liability that cannot be excluded or limited by law. This includes:
- mandatory consumer rights under Norwegian and applicable EEA consumer law;
- liability for gross negligence or wilful misconduct;
- non-waivable statutory liability;
- rights you have as a recipient of GPL-licensed components under the GNU General Public License, which are not affected by these terms.
7. Basis of the bargain
These limits are part of the basis on which the software and services are made available free of charge. If the limits did not apply, the software and services could not be offered as they are.
